Rights’ Recognition And Protection On City Cemetery

The main purposes of this paper are two :the first is to build a right system of the cemetery operators and the chief mourner in the cemetery, the second is to solve the difficulties the mourner encounters when his rights in the cemetery are affected.The first part of this paper introduces the concept,nature and kind of the cemetery.Then clear that the subject discussed in this paper is the grave type opreating cemetery in the city.The seconf part of this paper introduces three aspects.First,analyze the existing law of cemetery and find some deficiencies.Second,sum up the view in practice and theory about which rights the mouner has.Third,introduce what rights mouner has in other countries.The third part is to build the right system.There are two aspects.First,give a standard to clear the rights mouner has and then conclude that the mouner has the ownership of the cemetery.Second, discuss the limits in the exercise of the mouner’s rights.The fourth part is to discuss two difficulties encountered in practice,The first is about the identification and compensation for moral damage and the second is about the administrator’s responsibility.
