Research On Rules Of Korea Government Procurement

Korea is one of the early countries that have implemented the centralized purchasing in Asia. On the foundation of centralized purchasing, Korean government began to build and perfect its legal system of government procurement and expanded the market of government procurement by establishing the trade agreement and joining the trade talks. In this way, it tried to eliminate trade barriers with other countries. In 1994, Korea joined the WTO government procurement agreement(also known as GPA). After that, Korea enacted the specialized legal documents based on the GPA, in which the main body, object and procedure of government procurement was prescribed. It guarantees the operation of government procurement and improves the share of international government procurement market of Korea so that the competitive power of Korean companies has been greatly strengthened. China promised to join the GPA as soon as possible when joined WTO and it is negotiating actively to join GPA. For this reason, to study the Korean government procurement and the series of problems about GPA is good for the development of government procurement in China.In this paper, there will be five parts studying the Korean government procurement as follows:Part I-The overview of government procurement and GPA. In this part, the related concepts and main features of government procurement and the relationship between government procurement and international trade will be studied. As analyze of GPA is brought by the important effect of government procurement. The development and brief introduction of GPA will be analyzed by combining the procedure of Korea joining GPA and the development of Korean government procurement.Part II-The outline of Korean government procurement. This part will focus on the introduction of related system installation and institutional composition of Korean government procurement and the briefly introduces the content of Korean government procurement. There will be a brief evaluation of Korean government procurement in following parts. This part lays a foundation of analyze of specific system.Part III-Study of Korean government procurement entity. The problem of Korean government procurement entity is mainly about the main body, object, threshold values and applicable exceptions. There problems are starting with GPA. This part sets GPA as the start point, followed by analysis and evaluation about it. This part then analyzes the differences between domestic law and GPA agreement before Korea joined GPA, to explore the changes made by Korea for adjust. In this way, this country endeavor to find out the proper way to link up Chinese government’s procurement and GPA agreement, as reference for our country. The main body is including the central purchasing body, local procurement subjects and other enterprises procurement entity. Subject covers goods, service and project. The applicable exceptions are accepted by GPA. Examples of threshold values of Korean government procurement will be listed. In the end, the applicable exceptions of Korean government procurement will be analyzed.Part IV-The procedure of Korean government procurement. The problem of procedure is the key problem of government procurement. This paper will explain and analyze Korean government procurement through the point of implement procedures and relief procedure.Part V-Enlightenment that Korean government procurement provides to Chinese government procurement. At the end of this paper, the improvement suggestions to Chinese government procurement are proposed through legal system, target and principle, range of application, procedure and method, organization of procurement. These suggestions try to perfect the national government procurement of China to join the GPA as soon as possible, participate in international competition and improve the share of international government procurement market.
