Research On Several Legal Issues In Marine Insurance Subrogation Right

With the development of the internet and the globalization process of the world,the international trade is becoming more and more. The transport of goods by sea has always occupied an important position among the international trade. It can reduce the occurrence of other additional costs, but also avoid duplication of declarations, etc,but as we all know, maritime transport risks a lot and costs longjourney.The marine insurance industry is greatly contributed to the development of maritime trade. There are a lot of disputes relating to marine insurance subrogation rights in maritime dispute. But concerning marine insurance subrogation right handle disputes and trials still exist problems. These problems are not conducive to the development of China’s insurance industry.So I choosethe "Maritime" "Insurance Law", "Special Maritime Procedure Law" as well as representatives of several major maritime countries, as the research object.I used literature research, case studies, comparative studies, theoretical and practical combination of methods to explore several issues related to our marine insurance subrogation right, and make relevant recommendations these questions.Firstly, I use a case relating to marine insurance subrogation right to lead research questions,Then from the basic theory of marine insurance subrogation right point of view, to analyze the nature of marine insurance subrogation right, and in the country to enjoy the main marine insurance subrogation right, and finally focuses on the relevant marine insurance subrogation right several problems exercise the right of subrogation of marine insurance in the name of the problem, start issues of marine insurance subrogation right conflicts with the right to damages as well as the statute of limitations relating to the right of subrogation of the sea.The innovation of this paper is based on the way the case leads to the problem and the problems studied in this paper timeliness relatively high.
