The Research On The Chinese Chief Judge Responsibility System

The Principle of Responsibility of the Chief Judge is an internal system of the Court, which empowers the Chief Judge to referee the case independently, and is in order to change the phenomenon that the examination and the Judgment are separate and improve the efficiency and quality of trials. In the view of the realistic operating mode, this system has some positive significance on eliminating the shortcomings of the administration of justice and achieving the reunification of the "trial rights" and "sub rights" of the cases. It also plays an important role on the clearing the responsibility and authority of the Judges and thus contributing to justice and efficiency. However, it must be a clear understanding of the limitations of the system. For instance, the system lacks the guidance of the related legal system, and it breaks the existing legal provisions to some extent. The system security of the Court personnel classification management is still constrained by judicial localized. Therefore, the Responsibility of the Chief Judge need to be further improved. The Reforms shall be carried on in the Chief Judge elected, assessment, job security, assistant judges equipped, the reposition of Judicial Committee so on.
