Study On International Cooperation Path On Anti-trust In China

Private restricting competitive behavior has been a serious threat tointernational trade liberalization. Countries try to protect domestic market from theinfluence of foreign private competitive behavior by expanding the applicable scopeof the domestic anti-monopoly law, but the practice has caused more conflict.Antitrust cooperation becomes the best way to solve the problem. So countries havestarted to work in the field of antitrust. So far, it has formed the following four kindsof cooperation mode: the interest coordination type for developing the bilateraleconomy; the comprehensive integration type for establishing a common market;top-down type of unifying competition rules and down-top type starting fromcoordination.Our country "antimonopoly law" has been implemented for almost six years,while antitrust international cooperation had begun before the law promulgating. Sofar, the international cooperation on Anti-trust in China mainly includes china-EUcooperation dialogue combining with trade policy.China-US cooperation onenforcement of antimonopoly; China-South Korea cooperation against the pricemonopoly, Brics cooperation for protecting the emerging market competition. Thecooperation is still in its initial stage. The content is most about studying andexchanging experience. After promulgating the anti-monopoly law, the domestic legalenvironment has changed a lot. Therefore,the cooperation remains to be deepened.As one of the basic laws of market economy, antitrust legislation should besubject to the national economy, politics and culture. In the case of an uneven nationaldevelopment level, it can’t and there is no need to formulate unified competition rulesto solve the problem triggered by restricting competition behavior. Instead, the focusof cooperation should be on limiting competition behavior which has the outsideinfluence. With respecting the competition policies of other countries, China shouldtake in a variety of ways in the international cooperation path on Anti-trust, and takedifferent cooperation ways with different cooperation countries， In the last, amultilateral anti-trust cooperation system, consisted of an essential cooperation withcountry(or regions) of core trade benefit, a coordinative cooperation with country ofimportant trade benefit, a menu cooperation with trade growing country and the proclamation cooperation with country of weak correlation of trade benefit, is formed.This is our practical choice of cooperation way.
