There is no denying that, however, our country is in the transitionperiod of benefits and risks, accepting Wu Ying illegal fund-raising case, ZhejiangZhang’s nephew, Shanghai judge prostitution evens and so on, that we can’t help todoubt the judge’s judicial ability and professional quality. Network, the media can beseen everywhere on the judicial injustice, petition, the collective events, lead to publicdissatisfaction with the court, the judicial trust is losing in the public mind.Just under this background, the author is to study the construction of Chinesejudicial credibility. In the first part, starting with the connotation of judicial credibility,explain the justice, credibility, and judicial credibility in detail, from theperspective of ideological, political, economic, and cultural analyze the foundation ofjudicial credibility, and make clear the judicial credibility includes judicial judgment,judicial self-discipline, judicial power and the judicial form of res judicata.In the second part, at the macro level from different subjects introduces theNational People’s Congress, the social public, judges and lawyers for the judicialevaluation. At the micro level from the judge occupation, the court trial, the Judgmentand the social public opinion find the problems existing in the process of judicialcredibility construction in our country. And analyze the reasons for the lack of judicialcredibility from judicial system, judicial justice, judges and the judicial environmentfour aspects.Thirdly, introduce the construction of judicial credibility in United States, Britain and Japan, and then summary their experience to look at some enlightenment,emphasize the importance of judicial independence, the establishment of high-qualityteam with judges and promoting of judicial openness.At last, from Chinese national conditions bring up some possible solutions andsuggestions, advocate the judicial independence for the judicial system from theperspective of concept, finances, courts and judges. Establish judges team from thejudicial ability, professional ethics, the court management and professional security. Thetrial mechanism should ensure judicial justice and the public. Judicial supervision mustbe the correct specification, while consciously accept the law and the social supervisionand avoid improper influence by the outside world.
