The Society has entered into the Knowledge Economy Era, modern science andtechnology has also penetrated into all aspects of the social life, all kinds of social disputesare inevitably and more frequently involved in special problems about modern science andtechnology. So the expert opinion is playing an more and more important role in findingfacts of cases. Compared with other types of evidence, the expert opinion is morescientific and professional, so it is more likely to be believed. But in our country, thejudicial identification system is unsoundness, the unreasonable starting procedure, thenonstandard appraisal process, lacking of fully and effectively cross-examination andmany other factors result in a low reliability of expert opinion, the expert opinion ischallenged frequently. Although the various of laws and regulations gradually introducedincluding the new criminal procedure law and the new criminal procedure law areimproving the judicial identification system continuously, many problems are still notresolved, to improve the reliability of expert opinion needs further efforts in many aspects.This paper is divided into four parts, the first part mainly introduces the writingbackground, research significance,research status at home and abroad and theauthor’s research program; the second part explains the concept of the reliability of expertopinion; the third part makes concrete exposition on the low reliability phenomenon ofthe expert opinion,and analyzes the forming reason In two aspects:the formation processand cross-examination; The last part puts forward solutions, with the view to helping toimprove the reliability of expert opinion.
