Our Public health system needs innovation. It requires that each patienthas the accessibility to high-quality medical products. The level of theaccessibility is directly related to human health. Therefore the protection ofaccess to medicines is the bounden duty of our government. Nowadays, theissue of access to medicines is one of the prominent problems that affect ourcountry to build a harmonious society.This thesis consists of five parts; the first part introduces the researchbackground and significance of accessibility to medicines, and summarizesthe research status of domestic and overseas scholars on accessibility tomedicines research. The second part mainly introduces the protection ofaccessibility to medicines, which explains the meaning of accessibility tomedicines, and the three related three legal systems-pharmaceuticalmanagement, health care and pharmaceutical patent system. Meanwhile,theoretical basis of the legal system to protect accessibility to medicines isalso introduced in this part. The third part mainly compares the the legalissues of the protection of accessibility to medicines in different countries.The author compares the different legal issues of United States, Japan andIndia, disscussing the strengths and weaknesses of their system, andpointing out the inspirations and enlightments we can learn from the otherdeveloped and developing countries in their medical system. The fourth partmainly intrduces the current status and problems of the Chinese medicinessystem of the accessibily to medicines, which from the three aspects ofpharmaceutical management, health care and pharmaceutical patent. Thefifth part mainly disscusss how to improve china’s accessibility to medicinessystem, as well as the countermeasures for the aforementioned three.Our public health situation is not optimistic, the government should takemeasures on drug accessibility to improve China’s pharmaceutical industry independent innovation ability, to lower the price of drugs, to alleviate theproblem of “difficult to buy drugs”. Perfect patent law, guarantee thelegitimate rights of pharmaceutical enterprise, enforce compulsory importmeasures, promote the coordinated development of pharmaceutical industryin China.
