With the rapid development of the global economy, trade, especially international trade has become the main driving force to promote the global economic development. International trade makes the world a more rational allocation of resources in the world, as well as a great improvement in the level of the rate of development capital and technology, which not only accelerate the economic development, but also provide more funds to support environmental protection and technology. At the same time, expanding trade scale must be achieved through over-harvesting of resources, and hazardous waste generated in the production process must be transferred to mitigate the damage, the increasing negative impact of international trade on the environment have attracted more and more multifaceted attention. Human exchange environmental benefits for economic development, leading to an increasing odious environment, which curbs the further economic development, human beings must pay a higher price to govern the environment, the relationship between trade and the environment is in a vicious cycle now.China is a major international trading nation, foreign trade not only occupies an important position in the national economy but also be a medium towards the world, which led to the all-round development of the domestic economy, as well as created a favorable international environment for China’s socialist modernization construction. With the expansion of foreign trade, increasing imports of international pollutants, over-exploitation of domestic resource, wanton discharge of pollutants, resulting in China’s environmental pollution and degradation, dramatic reduction in plant and animal resources, the deterioration of the relationship between people and the environment, which all affect the sustainable development of our economy and the process of building a harmonious society. Faced with the increasingly tight relationship between environment and trade, our nation has not established a perfect legal system in order to coordinate the relationship between trade development and environmental protection, while promoting the healthy development of foreign trade as well as protecting our environment, to achieve win-win between trade and environment. Basing on the relationship between foreign trade and the environment, combined with relevant experience at home and abroad, this article coordinates the relationship between foreign trade and the environment through certain legislative measures.This article is divided into five parts. The first part, illustration of background, purpose, methods and current situation of scholars on trade and environment issues home and abroad in terms of this research. The second part, analyzing the dialectical relationship and the mutual influence between trade and environment from their relationship and development of evolution, laid the foundation for later discussion. The third part, illustrating the basic conditions of the influenced provisions in international environmental rules and analyzing the impact of these provisions and rules on trade and the environment in the context of the international environment. The fourth part, a comprehensive analysis of the existing environmental laws of China’s import and export, as well as the barriers in the development of the foreign trade. The fifth part, aiming at the problem mentioned earlier, proposing the corresponding improvement measures in order to coordinate the relationship between foreign trade and the environment, promote the coordinated development of economy, society and environment.
