| With the continuous development of the concept of human rights, people around the world are increasingly aware of the existence of discrimination and that mutilation phenomenon is not only a threat to women’s lives and health, more importantly, they caused the infringements of women’s human rights. However, due to the impacts of deep-rooted cultural traditions, customs, ideas, etc., there are many limitations of unilateral policy on women. In this context, the United Nations Commission on the Status of Women initiated to develop "The Convention on the Elimination of All Forms of Discrimination against Women (CEDAW)," which adopted by the United Nations General Assembly."CEDAW" has been involved worldwide extensively, greatly improving the impacts of the Convention. However, because of the problems of content and mechanisms of "CEDAW" itself, the effectiveness of its implementation is limited. Based on the background and contents of the "CEDAW", this article combines the features of the Convention and references of the implementation of the Convention in its parties, thus proposes the shortcoming of implementation of "CEDAW" in China and suggestions for improvement.The Convention on the Elimination of All Forms of Discrimination against Women is currently the most common, the most systematic and comprehensive international convention in the field of protecting women’s rights in the world. There were187States Parties to the Convention in the world, resulting a wide influence. But that does not mean that the Convention on the protection of women’s human rights has done impeccable. Abusing reserve rights, ineffective reporting procedures, limitation of complaints mechanism have limited the effectiveness of implementation of the "CEDAW", and the reasons that caused these difficulties will be explained in this article in detail. In order to better implement ef the convention, it needs to be improved in the following aspects. First, keep the rights to limit the abuse strictly, secondly, standardize reporting procedures to the States Parties, and finally accelerate the work of sign to the Optional Protocol.As one of the earliest states party of "CEDAW", China has been showing positive attitude towards the protection of women’s human rights. After accession to the Convention, China has made many efforts to fulfill our obligations under the Convention, and get a lot of results, as well as a lot of problems. This articlediscussed on the domestic level and international level respectively, and I believe that if China joined "the Optional Protocol to the Convention on the Elimination of All Forms of Discrimination against Women", we can do better in the field of the protection of women’s human rights.In short, the development and implementation of "CEDAW" can protect human rights of women deeper and wider, but it is also facing many problems and difficulties. Only to improve the content and mechanisms "CEDAW" further can we promote the development of the global women’s human rights protection more.Apart from the introduction and the conclusion, this article is divided into four chapters. The first chapter is "CEDAW" overview. The second chapter discusses the status of implementation and plight of the Convention, which undoubtedly undermine the effectiveness of "CEDAW". Chapter Ⅲ discusses the relationship between China and the "CEDAW".The fourth chaptermakes recommendations for "CEDAW". |
