Engagement, as an ancient historical phenomenon, is widespread in manycountries and regions. many countries have passed legislation to regulate in history.Nowadays, many countries established the related engagement system throughdifferent forms. After the founding of new China, engagement, as a kind of custom isstill the current common phenomenon in our society, which based on the influence oftraditional culture, and is still a marriage engagement as a necessary procedure ofmarriage in the vast rural areas. So it hard to avoid can produce all kinds of disputesin reality, and our country don’t have any rules about marriage.in the current law. Dueto the lack of engagement legislation in our country, we can’t resolve manycontradictions caused by the engagement, And seriously damage to the interests of theparties, even affect the life of our people. Therefore, it is necessary to adjust theengagement into legal scope.In this paper, I collected a large number of data, combined with the developmentof The Times, analyzed data, and borrowed from foreign legislative experience, thendiscussed the necessity of marriage legislation in our country, and put forwardlegislative proposals and ideas. In this paper, the text includes five parts.The first part: after discusses the concept of engagement, and I discuss the natureof the engagement, in order to establish the theoretical basis for later.The second part: analysis the difference between the history and modernmarriage legislation from the perspective of comparative lawThe third part: study and draw lessons from the abroad and Taiwan Macaoengagement legal regulation of legislation and practical experience, and theseexperience plays an important role for consummates in our country marriage lawsystem in the future.The fourth part: focus on research the present situation of the marriage in today’ssociety, and discusses the necessity and feasibility of the engagement legislation. The fifth part: give some legislative proposal about marriage on the basis ofprevious analysis.
