Criminal Law On The Protection Of Virtual Property

When the computer network has increasely become important power to develop the economy*connection and life, all aspects of the society has changed a lot. Especilly the communication between people and the flow of property has been gradually extended from the "real society" to the "virtual community","virtual space" and "virtual property" arises. Whether the virtual property would be able to get the protection of the real world and virtual property infringement behavior can be hit, this is the case discussed in this paper.The author firstly tried to define the "virtual property" at all levels, how it came, what it is, what belongs to it, what characters it has,all these problems should be the keys to disscus the protection of virtual property. Furtherly, compared with the traditional theft, the author began to analyse "the virtual property theft behavior", and tried to conclude its characteristics. Since then, the author analysed the reasons why the virtual property theft appears frequently, summarized the current status of virtual property legal protection, and explored the measures for the protection of virtual property.The innovation of this paper lies in:Firstly, new things such as the Bitcoins has been included in this paper when defining the range of the virtual property.Secondly, the virtual property right has been considered the mix of creditor’s rights and property,and we suggest that the criminal law should protect the creditor’s rights in virtual world.
