Study Of The Development Of Polish Constitutionalism

Twenty years ago, fall of communism in eastern Europe has had the profound influence on the world. Since then, the scholars at home and abroad have made a considerable achievements on the aspects of central and eastern Europe. In recent years, the research on central and eastern Europe gradually shows a tendency of all-round, multi-angle, multifaceted, and its research are also more objective and rational.Since Poland’s1791Constitution opened the modern constitutional system, the alternating and selection of several constitutions had been casting the development and perfection of the construction of Poland constitutional system. Carefully sorting out the history of the polish constitution, it finds the growth of the logic behind the polish constitutional system and the twists and forward of constitution of Poland style. A new constitution in1997was a basic summary of Poland type of constitutional road, marking the basic perfection of polish constitutional system. Based on the analysis of the history of the polish constitution change, exploring the cause and characteristics of polish constitutional road, and giving the example of five different historical development periods to analyze its constitutional system, it completed the analysis and research on the evolution of modern polish constitution and constitutionalism system, which points out that the characteristics, cause and revelations of the polish style of constitutionalism.The first chapter " constitutionalism ", analyzes the concept of constitutionalism and its difference with constitution firstly. And then illustrates the characteristics of transformation of constitutionalism, and the constituent of paradox, laying the theoretical basis for analysis of Poland style of modern constitutional forming.The second chapter " the evolution of polish constitutionalism, explores the background, content, characteristic and change rule of five typical periods of the polish constitution, through the brief analysis and evaluation, establishing the facts for the following analysis of the established facts. The third chapter " causes and characteristics of establishment of polish constitutionalism, first to analyze the causes of constitution and constitutionalism system, namely, the interaction of historical and cultural traditions, economic, government, parliament, Catholic and constitution, together constituting the construction of constitutionalism system. Then on the basis of analysis of causes, from the angles of the innovation of mechanism and system, the frequent change of the constitution, the people’s movement, the relationship between the government and the party, reveals the characteristics of evolution of of polish constitutionalism.The fourth chapter " the enlightenment of evolution of polish constitutionalism ", from the macro and micro aspects respectively, points out the polish road of constitution, embodying the value orientation and actual arrangement of the contemporary of the road of constitutionalism.
