Study On The Improvement Of The Appropriate Adult Participation System In Our Country

Because of special physiology and mental characteristics of minors, in principle helping minors to change by education and persuasion and ensuring judicial justice of the minor crime cases, the juvenile justice of our country enacts the juvenile justice system to highlight the purpose of education, persuasion and help. Appropriate adult participation system which is especially enjoyed by minors is a judicial proceeding that is able to effectively protect the rights and interests of minors. That is brings the unrelated third party into the minors’criminal procedure proceedings. By fully playing the functions of appropriate adult, protects the rights and interests of minors criminal, encourages communications between parties, supervises the procedure to be conducting in justice manor etc.The new criminal law was trying to explore the appropriate adult participation system and has recognized the practicing appropriate adult system by its provisions. It marks that the appropriate adult participation system of our country has changed into the theoretical construction stage from the practice fumble stage, which is a great progress of the juvenile justice system. However there are still many deficiencies in the legislative level and law practice. Therefore there is necessary to the academics for the systematic study of the appropriate adult participation system, to break through the difficulties of appropriate adult participation system and perfect the appropriate adult participation system.This paper is divided into four parts. The first part is mainly introduces the connotation of the appropriate adult participation system, and analyzes the value of perfecting the system that brings appropriate adult into minors judicial proceedings. The second part introduces the characteristics of appropriate adult participation system of typical countries, comparatively analyzing the contents of juvenile judicial involved in it, and emphatically introduce the evolution process of the appropriate adult participation system. The third part mainly analyzes the main deficiencies of our appropriate adult participation system in legislature level and law practice. In order to resolve the problem specified in the third part, and build perfect appropriate adult participation system, in the forth part, author introduces the advanced foreign experience, and put forwards perfecting suggestions, so that promote the process of appropriate adult participation system in legislation and judicial interpretation, and standardize the judicial practice.
