By reading Rawls’works and their related critical research results, apart from highly agreement with and appreciation of his appealing of substantial justice, it is also reflected profoundly whether formal justice approach that he choose could achieve his intention for substantial justice. Although it is definite that Rawls’approach of formal justice is brilliant and sophisticated, it is believed that his approach is not complete with at least several fatal defects. Rawls’s approach only emphasized the cooperative form of social organization, ignoring the competition that coexists with it; It places undue prominence to the role of institutional factors in the practice of justice, advocates priority for just with regard to good, find the foundation of a legitimate social norms, but did not see just is a good, thus ignoring persons in the practice of justice, including justice system build and implementation of the initiative, especially the role of the virtues of factors; it is not adequately considered that due to the difference principle that make people over-reliance their government, which may threaten their common life, and that the weak-oriented resource allocation damages social vitality and lures to one’s inert. Therefore, after we comprehensively understand the advantages and disadvantages of Rawls. With "reflective equilibrium", we can make a path selection more comprehensively and do a rational thinking more thoroughly, and ultimately choose to introduce such thinking in Chinese Context to help gain justice practice of our community as far as possible to form an embankment to resist the flow of utilitarian tide, which flows in the Chinese market to choose a more perfect way to make Chinese society is becoming more and more fairness and justice.
