| In the first year of The18th National Congress of the CPC The emblem of the Communist Party of China, along with deeping into three dimensional rural issues’ research, the rights and interests problems of farmers during the circulation of rural land are attracting more and more theoretical community’s attention. From the1980s, with implementing of the land contract system, the circulation of rural land started, and now it has been in shape. Especially after the third Plenum of the17th Communist Party of China Central Committee, the circulation of rural land expands on a large scale in the country, many scholars study in this area. Searching the systems of agricultural land since the rural reform, basic clue is always to safeguard farmers’ interests in land. But circulation patterns as the the emerging land in agricultural land reform in China-----The land joint stock system, this issue remains to be further deepen in academic circles. This article is based on investigation of Fenghuang Village in Xiaoshan District of Hangzhou, the rural land joint stock reform pilot villages, based on the legal system of background, combined with the reality in Pearl River Delta, Yangtze River Delta, Chengdu-Chongqing mode operation, as well as foreign countries like the United States, France, Germany and other equity set of legislative norms and funded are compared, analysing its existing legal issues, extracting significance for the legal opinion on the practice of the land joint stock system.During the comprehensive analysis of the joint stock reform of the rural land research, referring to the current relevant laws and regulations and policies, discuss the concept of rural land joint stock transfer process and interests in balance, especially its financial contribution and how to perfect equity issues.From the theoretical analysis of land of different regions in China and abroad land joint stock system mode architectures, the transfer processes and equity considerations, make a reference so that it will really promote China’s rural land joint stock development. |
