In view of a great deal of existing behavior that running yellow traffic lights on society, the traffic control department of the Ministry of public security incorporate the behavior into traffic violations. Cars that fail to pass the stop line on a yellow traffic light are prohibited from continuing to advance, then a fine or deduction of points is reasonable. The rule of forbidden running yellow traffic lights was widely questioned and criticized in the process of implementation. The traffic control department of the Ministry of public security finally announced that drivers who ignore yellow traffic lights will not be penalized for the time being. In terms of the rule that forbidden running yellow traffic lights, the legal basis remains questionable. As the rule is not directly derived from the rule of law, it is necessary to discuss whether it is in consistent with superior law. Through analyzing the related provisions of law by the method of legal interpretation, it can be concluded that the rule forbidden running yellow traffic lights is in consistent with superior law. The rule was supposed to get a smooth implementation as it both in accordance with the legislation original intention and has a realistic necessity. However, it was not widely accepted, nor did it get a smooth implement. The limitations which refer to the aspects of rule design, public participation and technological rationality can be found through analyzing. Those shortcomings finally lead to the deficiencies of substantial legitimacy. Although the rule will not be implemented for the time being, whether the behavior that running yellow traffic lights should be adjusted or not remains another critical problem. With the analysis of the principle of proportionality, it can be concluded that it is necessary to continue the implementation of the rule. Through presentation and analysis of the case which the rule hasn’t got smooth implementation in reality, it can be found that administration should integrate interventions with instructions and pay great attention to make administrative practice scientific, effective and equal. Proposed by scientific administration and democratic administration, democracy as well as reason should be taken into account while carrying out modern administrative practice. Furthermore, administration should turn from enforcement to acceptance.
