Research On The Localization Of Restorative Justice

Rising in the1970s, the restorative justice has been a kind of justice,which is aimed at patching up the social relations damaged by criminal behavior. It is totally opposite to the traditional punitive, retaliatory criminal justice. With the multi-participation and mutual communication between victims, the offenders, community members, it helps the victims return to the normal life from the impact of the crime. With the development around the world, the restorative justice has got a series of gratifying achievements in a new attempt to the model of criminal justice. This article try to analyze the existing related institutions timely, and put forward the feasible countermeasures, to perfect the relevant regulations, so as to improve the formation of restorative justice which accords with national conditions,along with absorbing the excellence method abroad as well as the pilot areas at the same time.This article is divided into five chapters, of which the second, third and fourth as the main body part. It introduces the origin and development of restorative justice, cardings the development procedure of restorative justice, explains the definition of restorative justice at home and abroad, then summarizes its specific characteristics, all of which will be the theory basis of concrete system incorporated into the field of restorative justice. This article presents an innovation that it analyzes the concrete institutions with characteristics of restorative justice in the field of criminal justice according to the connotation and extension of restorative justice, which emphatically analyzes its restore function how to play a positive role. According to the practical situation of the concrete institutions, we will find the problem of restorative justice in our country. And then, considering the reality of the development of the legal system in our country, according to the main problems above, it puts forward some countermeasures to perfect the restorative justice system. At the same time, we should draw lessons from foreign experience reasonably to realize and maximize these restore functions, make concrete institutions systematic.The practices of restorative justice at home and abroad and the active functions has achieved show that it has the superiority to promote in the judicial practice.
