Online shopping refers to the Internet as a trading platform. Under this platform the process of sales transaction between distributors and consumers is’paperless’with features including high efficiency, low cost, quick, and convenient purchasing. Having these features throughout the transaction process, online shopping has become more and more accepted by consumers and is now widely used. Online shopping accounts for a growing proportion of the trading market. Online shopping differs in a number of distinct ways from the traditional method being on a virtual network free from the time and space barriers of traditional trading.Chinese inadequate legislation and government supervision not only prevents the protection of online consumers but is having a negative effect on the potential rapid growth of our Internet economy.This paper aims to study a number of issues on protecting the legitimate interests of consumers online shopping at the present moment. The main reasons that cause the infringement of consumer rights are the imperfect system of identity authentication, difficulty in determining the legal effect of electronic evidence, and the complication of procedures of protecting customer rights. Moreover high technology content, high cost, and the difficulty of achieving consumer’s compensation needs to be addressed. Perhaps through new coercive government legislation.In comparison, the corresponding system has been established to protect the interests of consumers online shopping among the developed countries such as the United States, South Korea, Japan and the Organization for Economic Co-operation (OECD), and the European Union (EU) and other international organizations. However, there are still many problems in protecting the interests of consumers online shopping in our country. The most prominent issue is that there is no comprehensive laws and regulations corresponding to such problems. Therefore, we should establish more perfect corresponding laws and regulations to better protect customers’legitimate interest as soon as possible.According to the actual status of online shopping, using the advanced experience of the developed countries and international organizations in the legislation for reference, this paper claims the protection of the rights and interests of Chinese consumers online shopping should be improved by a number of the following aspects. Firstly, build a network credit mechanism, specify the legal effect of electronic evidence and standardize the system of administrative supervision and management. Secondly, the admittance and withdraw system for sellers in online shopping needs to be established. However, most importantly, consumers and sellers need to be given the opportunity to engage on a concrete dispute settlement stage. These include lawsuits and improved discipline from online sellers.
