Study On The Evidence Of The Victim’s Character In Sexual Crime

So far, China has not made any legislations about the evidence of the victim’s character.But in fact,the defendant always offers evidence of the victim’s bad character to make the judge turn to believe that,the complaint is lying and what the defendant has done is reasonable.Especially in such a situation, which women’s rights have not been admitted absolutely,victims of sexual assault suffer much prejudice from the society they live in.Inevitably,this may result in the excessive attention to the evidence of the victim’s bad character and cause a "secondary hurt".This article focus on introducing the rules of the victim’s character evidence applying in America so that we can gain a lot of experience from it.And from a feminist perspective,the author also analyze the potential reasons why there are few legal protections for women.At the same time,the author try to put forward a new standard for using the character evidence of the victim,in order to make some contributions to prospering country’s academic research.
