On The Development And Perfection Of Maltreatment Crime

In recent years, the word of "maltreatment" has become a hot topic in different websites and many incidents involving maltreatment has caught great attention from the society. Compared with the incidents in the past, these recent maltreatment incidents have broken the boundary of a family and become more complex and diversified with new characteristics appeared. Therefore, the reasonableness of the definition of maltreatment crime in our country was questioned by many jurists. Influenced by many factors, China’s legal legislation on maltreatment crime has appeared to be inadequate. The definition of maltreatment crime in the260th Article of Criminal Law has already aroused extensive attention from society; as a result, it has evoked great responses in legal community, so the voice to further develop and perfect the legislations on maltreatment crime has become louder.China’s present Criminal Law was revised in1997. It has undergone revisions8times from1999to2011. However, related regulations on maltreatment crime were never been mentioned in the8amendments. The author believes that it is time to revise the regulations on maltreatment crime according to China’s current social situation. Started from the efforts to develop and perfect maltreatment crime, this paper analyzed the current weakness of maltreatment crime legislation and proposed suggestions on legislation based on China’s national condition and foreign experiences.
