Subsequent Legal Migrant Workers Transfer Of Pension Insurance

In recent years, in our country, with the accelerating industrialization and urbanization,the number of peasant workers is also increasing year by year and the team presents agrowing trend. As a special group of peasant workers, they create much wealth for our societyand make a huge contribution to economic development and social progress. However, theirpensions have not been solved perfectly. On December28,2009, the State Council GeneralOffice forwarded ‘urban enterprise workers in basic pension insurance relationshipTransferriing and Continuation of Interim Measures’(hereinafter referred to as the ‘InterimMeasures’), which is the file of Human Resources and Social Security and Ministry ofFinance. On October28,2010, the Eleventh National People’s Congress Standing Committeeadopted the’ Social Insurance Law’ at the17th meeting. The two legal documents in relationto the pension insurance for peasant workers, compared with the previous legal documents,are indeed a huge improvement. However, the provisions of the transferring of pensioninsurance for peasant workers still exist some shortcomings.This article, which is proceeded from an actual case and combined with the relevantprovisions of the ‘Interim Measures’ and ‘social insurance law’, analyzes the shortcomings oftransferring and continuation in the current system about pension insurance of peasantworkers in China and puts forward some countermeasures and suggestions. In addition to theintroduction, the full text is mainly divided into five parts:The first part describes a small case, which indicates the problems of China’s peasantworkers pension insurance.The second part briefly generalizes the provisions of the new national policy, as well asthe provisions which had been taken place by many local governments on the issue before thenew policy was published. From these provisions, the part sums up the problems of thepension insurance of transferring and continuation about China’s peasant workers.The third part analyzes the problems of pension insurance of transferring andcontinuation about China’s peasant workers from the four aspects. The fourth part notes that what measures we should take to solve the problem on thepension insurance of transferring and continuation for peasant worker by presenting thelearnning from abroad.The fifth part sums up the earlier writings.
