With the rapid growth of e-commerce, private courier industry in our countryhas seen unprecedented development. As the end of2011, over7500corporateenterprises hold a courier business license in China, including52cross-provinces(autonomous regions and municipalities directly under the Central Government)express business network enterprises. They provide a variety of industries withtimely, safe, and reliable express delivery and information tracking services, andpromote the constant expansion of the national economy and international economicand trade exchanges. However, a lack of integrated regulatory system, legal vacuumin the express delivery market, and corporate culture issues have resulted in problemswithin the express delivery industry. Such problems, include delays, loss of goods,illegal operations, and uneven development. Therefore, there is an urgent need to findan appropriate regulatory approach to regulate the operations of the courier industry,and to create a fair and efficient market order.This thesis is a detailed analysis of the current state of development of China’sprivate express delivery industry, and reasons for market supervision and regulatorytargets from economic and legal perspectives. Detailed descriptions of the successfulexperiences of the express market regulators in the United States, Japan, Germanyand other countries shed light on strict express market access standards and theestablishment of independent courier industry regulatory authorities. Also included isan analysis of the problems in our express industry market’s regulatory process fromthe aspects of the law, industry self-regulation, the internal control system of theexpress delivery companies, and corporate culture construction. This study hopes toaddress the issue of how to establish and improve the supervision system of China’sexpress delivery industry. The design of the regulatory system aims to the greatestextent possible to avoid in the process of delivery such problems as theft, damage,and disputes, and to reduce the risks borne by consumers, give full consideration tothe interests of stakeholders. It is hopes that the efficient allocation of resources, bothin terms of division of labor and coordinated management will bring forth the healthy development of China’s express delivery companies in a fair, just and orderly marketenvironment. |
