Legal Reserch On Sysyem Regulation Of Outer Space Debris

Since the first satellite and the first astronaut were send into outer space, spacetechnologies are constantly evolved. Space activities have deepened humanunderstanding of space, but human spaces activities also have obvious negative effect,increasing of the space debris is polluting the space environment. United States, Russiaand China are major space powers countries, they made space debris at an alarming rate,and these acts are causes serious threat to human space activities, that’s why the spacedebris problem has aroused widespread concern in the international community. Usingin this research standard and comparative methods analyzed the system regulation ofouter space debris, which including the international space legal system and domesticspace legal system of the major space countries, focusing on its positive aspects andshortcomings, and put forward sound proposals.From the domestic space legislation of America, Russia and China, these countriesestablished the legal system of space environment protection. In the legal system ofregulation space debris, these countries’ domestic laws of space debris improved thegovernance role in promoting of the international legal system. These countries’ legalsystems provide specific measures for space debris control, at the same time these legalnorms should prevent new space debris. United States and Russia’s legislation of spaceenvironment protection have not specific measures of mitigation the space debris, thereare no clear concepts of space debris. But the space legal system reflects the inherentrequirement for preventing space debris generation. From a technical point of view,United States and Russia have established standards for mitigation of the spacedebris.China had realized urgency of such standards for regulating of the space debrisproblem, that’s why China National Space Administration established “2006-2020plane program of the development on the action of the space debris”. Compared withRussia and the United States, China government has not yet adopted national space laws.From international space legislation, international organizations initiate efforts forthe space debris mitigation. Established by the United Nations five outer space treatiesadjusts the basic norm of international space activities, provides the legal framework forthe regulation of space debris problem. Increasing of the space debris are forced theinternational organization needs to improve legal system of regulation outer spacedebris, and protection space environment. Specifically, in the first time we must createthe international convention of the legal regulations of the space debris. Secondly, tocomplement the legal system regulation of the space debris, international environment conventions must be modified. Finally, in practice, make clear management functions ofspace debris institutions, and build a new model of international cooperation.
