The Civil Legal Liability Problem In Commercial Housing Subscription Book Research

In China’s real estate transactions among existing homes there are two modes oftransactions and forward delivery housing transactions. Built in practice developersduring the sale, more difficult to achieve our statutory pre-sale conditions, and thusthey are often the first people to sign and buy a subscription book housing pre-salepermits to circumvent legal obstacles and other facts not obtained obstacles.However, the subscription book is legally binding, its legal nature of how andwhether a violation of our pre-sale permit legal systems are difficult to identify, lackof law led to a large number of disputes arising. This paper is based on the legalnature of the appointment contract from the perspective of commercial housingsubscription book, and from the relevant theory of two legal systems appointmentcontract legal liability and legislative perspective to be reference, analysis of China’scurrent legal responsibility for the commercial housing in the book of the bear’sstatus, to point out the existing problems, finally put forward their views andsuggestions aiming at the existing problems in china.
