The Perfection In The Local Legislation Of Chinese Anti-domestic Violence

Domestic violence is a social problem which exists all over the world. Based on their ownhistorical experience and national conditions, many countries have made relative laws toprevent domestic violence. Mature experience on anti-domestic violence legislation has beengained in America, Canada, Swiss and Taiwan.Although till now China hasn’t developed national law, the legislation has been the focus oflegal experts.22provinces in China have formed local regulations. However, manyproblems come out for lack of unified legislative frame. For instance, the definition ofdomestic violence is not fixed; the related government departments are not clear about theirscope of responsibilities; and it’s difficult to collect the crime evidence. Through lookinginto the contents of these local regulations and problems occurring in practice, thiscomparative study tries to find out the shortcomings of local anti-domestic violencelegislation, and put forward proposals on the perfection of the legislation.The present paper consists of three parts. The first part reviews the current anti-domesticviolence legislations home and abroad. The second part analyzes different local regulationscomparatively. The third part clarifies the specific proposals on perfection of localregulations. Finally, the writer thinks that further discussion and exploration are necessaryfor the future national anti-domestic violence law.
