Research On The Legal System Of Rural Construction Land

After the founding of New China, especially after the rural commune movement,forming a dual management model of urban-rural divide and conquer, to obtain land for urbanconstruction, planning, development, use, transfer, exit and other legal requirements are quitedifferent, However, with the accelerated pace of urbanization, urban construction landincreasingly saturated, and the problem of the dual management model has becomeincreasingly prominent, development and utilization of rural construction land, carrying outthe integration of the town become a necessity, especially after the proposed unified urban andrural construction of eighteen land market, the author provides academic direction. Thisarticle in the Perspective of Economic Law, based on the current problems that exist in ruralconstruction land systems, and explore analysis of rural construction land planning system toobtain system, circulation system and the exit mechanism to improve China’s ruralconstruction land market.In this paper, literature research, qualitative analysis, historical research methods,analysis of rural collective construction land planning system, circulation system, propertyrights and homestead exit system and problems in the management process, and borrowingthe United States, Germany, Britain and other foreign a typical state on the successfulexperience of the construction land management system, combined with China’s actualsituation, explore and improve our rural construction land legislation conception.At present, domestic and foreign scholars on rural land system is mainly from theresearch point of view of constitutional law or civil law expanded scope of the study focusedon the integration of urban and rural areas, urban and rural construction land use system,construction land use rights, land use rights, commercial land the price of shares, landmanagement, land development, land evaluation, etc., in order to compare the perspective ofeconomic law on the reform of rural construction land less institutional research scholar in theurban-rural integration background. Therefore, I tried to use the basic economic law theory,analyzing the current situation and problems of rural construction land system in China, forthe implementation of land reform and rural development system, the integration of urban andrural construction land to build modest contribution system.This paper consists of five parts: The first part of the introduction, describes thebackground and significance of the topic,"the integration of urban and rural land market"policies as a background detail present research status and research results at home andabroad, put forward their own ideas and writing articles the basic language of context; second part, based on the concepts of rural construction land system to sort out, the articlefrom the perspective of economic law establishing rural collective construction land andhomestead as the main object of study style; part III analysis the status quo of China’s ruralconstruction land legislation and problems; part IV summarizes the typical foreign nationallegislation beneficial practices on the successful experience of the practice of land-use andsuitable for China’s actual situation; part V proposes to improve our rural construction landlegislative proposals in rural construction land planning system, circulation system and exitsystem should give full play to the right to participate in rural villagers, to be clear on thesubject of property right, and limited construction land.
