Research On The Consumer-Rights Protection Of Natural Monopoly Industry In China

Consumer-rights of natural monopoly industry in China have been infringed from time to time,with a growing influence. Therefore, how to regulate natural monopoly industry of our country andprotect the legitimate interests of consumers has become an urgent problem.With considering the particularity of natural monopoly industry and the actual conditions of ourcountry, the paper first proposes a series of suggestions to improve the traditional consumer-rightsprotection system of natural monopoly industry in China. They mainly include the following: first,re-define the scope of exemption of natural monopoly industry in our country, introduce somecompetitive mechanism properly; then, draw service convention of natural monopoly industry in ourcountry; at last, focusing on the six aspects of quality control、price regulation、information publicity、standard form contracts review of public goods and services which are provided by the naturalmonopoly industry, the obligation of advance notification、preventing losses and confidentiality whichborne by natural monopoly industry, the paper tries to perfect laws and regulations system of naturalmonopoly industry in our country.The paper also tries to construct the public interest litigation system and non-lawsuit rightsdefending system for consumers of natural monopoly industry in China. In the construction of thepublic interest litigation system, this paper considers we should relax the qualification standards forconsumers as plaintiffs properly, strengthen the consumer association’s due qualification as a plaintiff,reverse the burden of proof, improve the standards of compensation, the court should strengthen thejudicial review of some major disciplinary actions and agreements, expand the effect of the judgmentproperly. In the construction of the non-lawsuit rights defending system, the paper suggests makingbeneficial attempts which should concentrate on improving the consumer association’s voice, settingup the consumer complaints records system and consumer rights protection funds.
