"San Yan" story and "Er Pai" story are the masterpieces in the oral short stories of the Ming Dynasty. Detective theme works which are the part of both stories represent the highest achievements of ancient Detective Fiction. These novels contain lots of vivid characters, exciting plot, clever artistic expression, rich ideological content, rich connotation, and society life. It reflected the people’s social ideology, and contained very complex legal relationship. From these legal relationship and historical background of story, legal Culture is researched.This thesis is divided into five chapters.Chapter 1: Overview of the Creation of "San Yan" and "Er Pai" story. From the study of the legal environment in Ming Dynasty, mainstream legal thought and people’s legal awareness in novels and the effect on Legal Thought of detective story will be understood. Novel sources are classified at the last.Chapter 2: Detective Fiction and Legal Culture. Through the study of novel language and plot, this chapter tries to clarify the fusion between plot and legal culture in the process of literary creation and how the novel language precisely reflect judicial statutes. The legal and the reasonable legal is also expounded.Chapter3: Detective Fiction and judicial decrees. Compared the legal details between the "Da Ming Lv" and these two novels, it is concluded that the judicial statutes in the Novels and the judicial practice in the Ming Dynasty are identical verdict. Culture character in detective fiction and the judicial evidence that novels are originated from the practice but exaggerate it is discussed.Chapter4: Detective Fiction and the Lawsuit Idea. By analyzing the lawsuit idea in novels, This chapter studies the social and economic reasons of the forming of the lawsuit idea. The proceedings and litigation psychology of the average people is explained too.Chapter5: Judge Image. Detailed interpretation has been made to account for the Judge image who played a pivotal role in the ancient judicial proceedings. Based on the thoughts of the “Qing guan” worship and the comparative study of "Qing guan" and "Hun guan" in the novels, we can see that judges play a decisive role on the result of the judicial practice. Incorruptible judges effected legal justices.
