Reasonable Restrictions Of Self-determination In Egg-freezing

Assisted Reproductive Technology(ART) has been widely used with the rapid development of Modern Medicine, and it’s no longer only used in the area of infertility, but also offers a reproductive insurance with Sperm and Egg-freezing Technology. Egg-freezing, is a technology that removes healthy eggs from woman body to avoid senescence with human aging, and take it out when frozen egg fertility can use. Egg-freezing has been a derivative of Assisted Reproductive Technology. In addition, there is no full Self-determination in Egg-freezing of Chinese women according to the relevant rules and regulations, which means that there has been restrictions of qualification 、 implementation procedures & agency、 technology in egg-freezing、using and donating. The reason for this is that the Self-determination in Egg-freezing has a tension between legislation、policy、ethics and other interests. However, as a fundamental right deduced from Constitution, Self-determination shall be fully protected, therefore, restrictions on Egg-freezing in the Self-determination must have legitimate purposes and reasons, not only consistent with due process, public welfare and public order and good morals, but also in line with the personality of self-discipline, so as to protect the right of Self-determination accurately and achieve balance of interests and rights.
