Forensic psychiatry is a complicated and marginal subject with integration of psychiatry and law. So, it includes medical components and legal components and it is a branch of both psychiatry and forensic medicine. Based on theoretical technique of clinical psychiatry and guided by the theories of law, it mainly studies and solves problems of law and psychiatry involved among mental patients. Moreover, it is also an emerging science which is mainly explored in this paper. Though forensic psychiatry has been established for 100 years only, it can be found in the long process of history. The establishment of any subject cannot be separated from historical deposits and its formation is also connected with social background in those days closely. The establishment of forensic psychiatry was of closer connection with development of psychiatry and development law, but similarly, it cannot be separated form its social and cultural background. For deeply studying the subject, we should not only focus on its current development, but also pay attention to its history and its evolution process. Nowadays, we have rules and laws to follow when mental patents violate laws and they have human rights as well. In ancient times, how ancient people treat mental patients when they violate the law? What are the laws and rules to deal with law-violating mental patients in ancient China and west? And what is their difference? According to time sequence, this paper divided history into four stages:ancient times, middle ancient times, modern times and contemporary times, and summarized legal regulations on mental patients in chinese and western history and carried out comparative analysis on them, wishing to find out difference of developing history of forensic psychiatry of China and the west and its influencing factors and provide foundation of literature for development of forensic psychiatry in China.
