Study On Counter - Guarantee Measures To Replace Real Estate

With the development of China’s economy, private economy has become increasingly important. However, the survival and development of Chinese private enterprises have become increasingly difficult, facing a series of problems, the most important problem is the financing. The production of guarantee company, especially the financing guarantee company, precisely in line with the needs of development of Chinese enterprises, especially private enterprises. In recent years, the development of China’s financing guarantee companies has made remarkable achievements which have improved the financing problem of SMEs,but due to various factors, the development of guarantee industry is also facing a series of difficulties. For example, the lack of counter guarantee measures. And the provisions of the law system of Chinese counter guarantee measures are not clear, letting the Chinese Guarantee companies face great risks in the development process. The risk and income of Chinese Guarantee companies does not match. As the relatively under-developed province in economic, this issue is particularly prominent in Yunnan. The Guarantee companies in Yunnan have a lot of obsessions when they guarantee for the SMEs. The living environment of Guarantee companies is not friendly. The lag of information and knowledge, the lag of economic development and the lag of implementation of the policies and regulations exacerbated the difficulties of survival and development of Yunnan’s SMEs and guarantee companies.In this paper, on the basis of the development status and problems of financing guarantee companies, reviewing the related theories systematically analyzing the counter guarantee measures, with a comparative analysis of the characteristics of equity, movable property and real estates guarantee measures, it gives the practical application of equity, movable property counter guarantee measures in Yunnan. Finally, with the author’s experience in guarantee company, the author analyses cases of the production enterprise and business enterprise, and designed the risk controllable and operable alternative counter guarantee measures of real estates. This research has important theoretical and practical significance, and has important reference value to guarantee industry.
