The Research Of Environmental Law Problems In The Development Of Distributed Wind Power Generation In Our Country

Since the first global energy crisis broken out in the 1970s, how to balance the economic and environmental benefits as well as the growth of economy, environment and energy has been a challenge facing in front of every country. With the improvement of energy structure and the innovation of energy supply modes, Decentralized wind power generation emerged. Compared with the traditional centralized energy system, Distributed wind power is more flexible, it can reduce transmission losses, lowers carbon emissions and increase the security of supply nationally. In light of this, the Distributed wind power has been adopted by more and more countries. In recent years, the Distributed wind power has become the most rapid development of Decentralized Energy (DE) due to the mature technology and significant financial potential.There are three stages with different polices, support and concern in the development of Distributed wind power in China. Simultaneously, the operation model goes differently, including offline, combined/offline, combined/online, local combined and global online. According to resource differences, the business pattern can be divided in to two kinds, that is land wind power and sea wind power. Meanwhile, Distributed wind power in other countries, especially in America, Germany, Japan and developed Western Europe countries, is well developed after experiments and investments over a decade with environmental policy, which may help us to promote the development of Distributed wind power.Due to the incomplete environment law system and the supervision and management, and the racing environmental problems, the development of Distributed wind power is in deep trouble. Here we will offer some suggestions in four ways about environmental law problems in the development of distributed wind power. First, we should enhance the environment law in order to ensure its well development as well as offer effective guides. Secondly,reinforcing the environment protection policy including the recording of influence on environment, emergency response, public involvement and environment supplement is also important. Then, it’s necessary to improve the supervising policy system, clarify the supervising function and bring into full play the role of public supervision. Finally, strengthen the protection of pollution and ecosystem namely, pollution prevention and control measures and ecological conservation measures.
