However, in the 21st century, pollution is becoming a serious topic with the rapid development of China’s social economy and rapid deterioration of the natural environment. Faced with the grim situation of environmental pollution, requires not only the relevant state departments to strengthen management to prevent the occurrence of environmental pollution, the need for timely remedy environmental damage. At present, both common law countries or civil law countries, have established environmental public interest litigation, environmental public interest litigation rights conferred varying degrees prosecutors, n recent years, all over the country involved in the prosecution of environmental public interest litigation has been actively explored and achieved some success, but our prosecution in environmental public interest litigation in the main positioning is not clear, in a rather awkward position. This will combine the environment of the prosecution filed public interest litigation case in the analysis of environmental public interest litigation abroad, based on the discussion of prosecutors involved in environmental public interest litigation and the practical significance of the environmental public interest litigation should be at the legal status, and this put forward specific vision.
