Economic development of the urbanization process has stimulated a series ofindustrial development which needs a lot of land for construction requires toinvestment in, and land protection situation is increasingly grim. In the doublepressure of economic development and the protection of arable land, constructionland increasingly prominent contradiction between supply and demand balance. Inorder to make efficient use of construction land and protect arable land, manycountries have undertaken studies of land development rights, and they started touse market-oriented means to manage construction land at the institutional level.In China, the Land Use Planning System and Land Usage Regulation Systemalready revealed their drawbacks in the fairness and efficiency, and they need toreform appropriately.This paper studies the different of U.S. TDR (Transfer of Development Right,referred TDR) and PDR (Purchase of Development Right, referred PDR) withChinese existing Construction Land Transfer System. In this paper, we combinedwith China’s current institutional background and economic environment, believethat China comes to the right time to set bolder attempt of land development rightsfor construction land management system reform at this stage. This paper arguesthat China needs to implement construction land allocation management systemreform practice in provinces, and need to build a Chinese characteristicsconstruction land allocation management system which dominated byadministrative means, supplemented by market means.This paper designs the framework of provincial Construction Land AllocationManagement. This paper argues that, after delineating land zoning, restrictions ofdistrict land development level, building platform of provincial Construction LandAllocation Management System and taking the transfer and economic indicatorscompensation system, can achieve protection of arable land and the environmentand increase the efficiency of the allocation of construction land. And through theestimates and analysis of construction land’s marginal product in HeilongjiangProvince, has confirmed there is space of construction land allocation inHeilongjiang Province, which in turn results in other provinces also havepossibilities of construction land allocation. And by GAMS (General AlgebraicModeling System) for construction land marginal differences nonlinearprogramming problem seeking to maximize the optimal solution, confirmedthrough the deployment of construction land, Heilongjiang Province, the regional land use and an increase in marginal revenue.
