| Pharmaceutical industry belongs to the boom industry which possesses high technology, high investment, high risk and high benefit, largely depending on the protection of intellectual property rights. After becoming a member of WTO, our pharmaceutical industry has been facing the strike of the international market, but the protection work is gradually on track due to our continuous exploration. Patent technology has already become the lifeline of pharmaceutical enterprises and the driving-force of pharmaceutical industry, in which the patent technology has played a very important role. As an inland province, Shanxi Province has a relatively slow economic development and backward science and technology level, which weakens the competition capacity of its product and thus causing a big disparity compared with the domestic and foreign markets. This essay applies the patent data provided by the State Intellectual Property Office since1985, tries to build a comprehensive system of collecting and organizing the medicine patent information of Shanxi province, and uses patent analysis method and bibliometrics method to analyze the indicators. The final patent data and analysis results are expected to provide a reference for pharmaceutical enterprises to formulate scientific and reasonable patent strategy, and to provide consultation service and decision-making basis for relevant departments relating to intellectual property right.The essay includes six parts. The first part introduces its background, data sources, methods, and content. The second part analyses the overall situation of patent from five aspects. They are the development trend of patent, types of patent, IPC classification, annual growth rate of patent and legal status of patent. According to the results, up to November2012, the total number of pharmaceutical patents of Shanxi province is3941, which presents a rising trend. However, the annual growth rate is unstable. Giving the invention patents the priority, A61K and A61P are the largest parts and most innovative in the field of technology. Patents that have no intellectual property rights account for more than half. The third part, deeply excavates the patentee fields and systematically researches the forms of the patentee, the industry-university-institute cooperation and regional distribution, then the concentrated distribution enterprises of patent technology is summarized. The results show that the number of the patentee (2196) increased with each passing year, in which individuals account for89.03%and the enterprises6.51%. The cooperation between production, study and research is in serious insufficiency, the medical development in different regions is unbalanced, with Taiyuan, Changzhi and Yuncheng running in the front rank. Shanxi Zhendong Pharmaceutical Co., Ltd., and Shanxi Yabao Pharmaceutical Group Co., Ltd. are among the stronger enterprises in the province. The fourth part studies the overall situation of patent development of the domestic pharmaceutical industry. It finds the disparity and the weak link within Shanxi Province by comparing with key provinces (Shandong province and Jiangsu province). The results show that the quality and quantity of Shanxi patents is relatively backward, and it lacks the powerful pharmaceutical companies. The patent development is lagged behind. The fifth part summarizes the current development of pharmaceutical industry in Shanxi province according to the results of the analysis, and puts forward some reasonable suggestions respectively from the levels of the government and enterprises. The sixth part summarizes the whole essay. |
