China has the maximum amountof mariners,1.55million, of which650,000are seamen, and they are playing animportant role in China’s foreign trade. Compared with other occupation on land,seaman is more dangerous as recognized. Considering the particularity of thisoccupation, seamen need some special legal protection. Seafaring labor exportinvolves complicated legal relations among seamen, dispatch seamen serviceorganization and foreign ship owners. The laws and regulations of protecting theseamen in our country are badly deficient, which leads seamen’s working conditions,wages and other basic rights and interests are often violated. These problems areaffecting the physical and mental health of the seamen and could cause dangers to thelife and property on the vessel. Therefore, researching how to protect the rights andinterests of seamen better has its practical significance.This thesis dissects legal relations among seamen, dispatch seamen serviceorganization and foreign ship owners deeply on the basis of the definition andparticularity of seamen, which clarifying the position of dispatch service organizationand foreign ship owners during seamen’s export as well as the responsibility theyshould undertake. Based on the above, the thesis combs through the exposition of thelegislative status of perfecting seamen’s export protection, and suggests them legaland institutional security from improving the legal norms, strengthening thesupervision, regulating on operating activities of dispatch company, and building thecoordination mechanism. It is put forward in the end that perfection of the legalresolution of seamen dispatch will not only promote the actual salary and income forseamen, making them decent, but also response positively to Maritime LaborConvention in2006come into force, constitute a significant meaning for integratinginto the new order of international shipping industry as well.
