Since the Open and Reform, the increase is not only figures of GDP, but also thehappiness index of people in China, especially China’s accession to the WTO makesenterprise more prosperous, nation more powerful and strong. But the contradictionbetween labor and capital doesn’t disappear with the development of economy, insteadof more and more appeals of labor rights. For example, there recently happens “jumpingfrom building” in Foxconn, the228events about fled back pay in Zhejiang, Karoshi ofbeautiful Master, Abuse of workers on GUCCI in Shenzhen and something aboutShanghai’s Hebi Household Electric Appliance Plant abandoned thousands of workerswithout any reason overnight, and so on painful events, which tells us a fact that the ageof “Strong Employer and Weak Labor” shall not pass away, the need of undertakingcorporate social responsibility and our country’s legal protection of labor rights hasworkloophole. Labor Law and others branch laws in our nation are labor’s weapon fordefending their rights all the time, however, its keeping pace with the times is destinedbecause of the change of time. Just ISO26000, the national social responsibility guide isissued in2011, which is a moral system can help and promote Chinese legal work oflabor rights’ protection. The labor practice issue of it adds a number of rules about laborrights’ protection, which can provide new reference for consummating the currentlegislations relate to labor. Besides, China’s national condition provides the possibilityof theory and practice for implementation of ISO26000. Therefore, I think we shouldfollow the tends of Economy globalization, regard the implementation of ISO26000as aopportunity of improving our courtry’s legal protection of labor rights and make acontribution to the harmony of relation between labor and capital, society and world.Based on widely collected data, the article plans to be divided three parts to elaboratethe legal protection of labor rights on the backgound of ISO26000. Firstly, I will explainth relationship between ISO26000and the protection of labors rights by combiningmeanings of legal protection of labor rights and ISO26000and the value of ISO26000for the legal protention about labor rights. Secondly, state the superiority of ISO26000through comparing ILO, SA8000, related rule of WTO and our country’s system andconnecting cotent about labor practice in ISO26000. Lastly, analyse the possibility ofISO26000’s introduction, and then discuss the strategy on the legal protention aboutlabor rights in the current law set. Due to the time of issuing on ISO26000is short and there is little research about it at home and abroad, in addition, the study on the legalprotention about labor rights is even numbered. The innovation of paper is to usecorporate social responsibility as backgound to analyse the question of labor practice byinterpreteding ISO26000and contrasting previous standard from the brand new view ofISO26000, meanwhile, the article also applied the methods of empirical research,deductive reasoning, document study and combing with reality in order to betterresearch the question of legal protection about labor rights on this backgound.
