Our Military Marriage Special Protection Scrutiny And Improvement

Since the Revolutionary War, our law has carried on a fine tradition of givingspecial protection to military marriage. When modifying the new Marriage Law in2001,all experts and scholars of civil society launched a wide-ranging discussion on whetherto retain these rules; following extensive public discussion on the special protectionrules and on weighing the pros and cons for the parties, they finally added an ‘exceptionclause’ in the law. This initiative had temporally eased the conflict between the soldiers’desire for marriage special protection and their spouses’ pursuit of freedom of marriage.However the exception rules had little success and contradicted with the essence ofmodern law which pursues freedom, democracy and equality, no fundamental changeoccurred.
