CHINT v. Schneider patent infringement case is not only a major case, but also a complete picture of a patent infringement lawsuit in the trial procedures and applicable law issues, it is worth finishing, thinking and studying.This paper aims to study the important legal issues reflected in the case, mainly involves the following:Firstly, stay of action caused by invalidation. Secondly, how to determine the scope of patent protection. Thirdly, the plea on the ground of interference application. Fourthly, the technical comparison in prior art plea. There are many plea causes in patent infringement lawsuit. This paper focus on the new plea which is on the ground of interference application, and study it from the angles of law foundation and legal principle foundation. Most previous researchers named this new plea’prior patent plea’ and included it in prior art plea, this paper names it ’interference application plea’ for the first time and study it independently, so, this part is the innovation point and the key point of this paper. Moreover, combined with concrete case and based on analysis the theory of prior art plea, this paper criticizes some wrong methods in the application of patent law, and puts forward the suggestions.
