Hayek is an important thinker in modern times in the western, he isalso one of the representative of new liberalism. This paper expounded hispolitical philosophy.Economically, hayek’s theory is on the counter isproposed on the basis of Keynesian economic theory. After his oppositionto Keynesian theory of state intervention that market economy based on thetrue individualism to make social healthy development. Hayek first embarksfrom the limitation of human reason, this paper expounds the binary viewof its rules and order, human behavior rules can be divided into internaland external rules, these two kinds of rules and organization order andevolved from the spontaneous order. Hayek thought only based on theinternal rules of authigenic spontaneous order to maximum play to thecreativity of people, safeguard the freedom of the individual.Rules and order is the core of legal theory, the late hayek will studyfocus to the field of law, has formed the hope that through carry out theideal of private law, public law form in his mind only following theinternal rules, private law is to maintain the legitimate behavior of akind of negative freedom under the rule of social norms.
