Professional graduate education in China has been started since1991,and full-time students have been taken in after2009. Since then, the professional graduate education has been developed very quickly in our country during the last20years. As a new kind of degree, professional degree not only has adjusted Chinese degree structure which had only one academic degree in postgraduate level in the past, but also is helpful in the further development of Chinese higher education. However, there are many problems in entrance, training and other parts in the process of rapid development in the past20years. These problems are close to the macro factors like the faultiness of the laws and regulations in our higher education especially in professional graduate education, the imperfection of administration system in higher education which is not adapt to the Times and and so on. However, we concern that it’s necessary and important to establish guarantee system from a legalistic perspective on the basis of the analysis of the existing problems in the present professional graduate education. As a result, the professional graduate education in China is probably to develop in a healthy and orderly way.The paper includes three parts:Firstly, it interprets the developmental background and course of the development of professional degree in our country from the perspective of notion of professional degree. Then, on the basis of analysis of entrance, training, examination and employment, the study points out the problems in the course of development, such as the faultiness of relevant laws and regulations, the weakness of community involvement and analyzes the causes. After that, under the introduction of the development process and experience of the professional graduate education in USA, Britan and Japan, the research proposes the corresponding countermeasures form the legal system angle: improving the relevant laws and regulations about professional degree; perfecting the professional degree’s system and the related management system; reforming the revelant institutions and ensuring the high quality of professional degree; establishing diversified system of examining and assessment as well as completing the connection with the vocational qualification certificate.
