Right, obligations and responsibilities are always attendant, and consumer problems are not confined to the protection of their legitimate rights and interests. Consumer, as an important mainstay of the market economy, has been a weak group and been protected by national legislation. But special protection of consumer laws allows people to ignore the exception of consumers’consuming behavior. With the rapid development of China’s economy, the types of consumer goods are increasing, and the phenomenon of irrational consuming becomes increasingly serious. Waste of resources, excess waste and other waste problems are also countless. Some consumers wantonly squander just in order to show their social status. This leads people to dislocation of correct values and loss of spiritual beliefs. It has a serious threat to a person’s sound development of health, and threaten the sustainable development of China’s economy, society and ecological balance. In recent years, countries have begun to attach importance to the consumer through a variety of policies to regulate and guide the rational consuming, when we emphasize the social responsibility and obligations of government,such rational consumption of consumers’ social responsibility also plays an unavoidable issue. For the pursuit of efficiency of economics can not solve this, we can resolve this issue through the pursuit of fairness and justice of laws.This essay is composed of three parts. The first part is the foundation of the whole passage. It interprets and defines the meaning and theory of consuming, economics and in law, and points out the improvement as well as limitations of the new Protection of Consumers’Rights and Interests. The second section mainly discusses the guiding mechanism and practical experiences of irrational consuming overseas. Their mechanism can be non-legal or legal. The former one includes participation of social organization, moral self-discipline of consumers, and the effect of religion; while the latter one includes the government’s guidance in law to rational consuming, consumer bankruptcy system which confines exhausted consumption. The third part is the emphasis of this essay and also where innovation lies. It studies the construction and improvement of guiding mechanism of irrational consuming in China, including legal and non-legal guiding mechanism, and tries to find a solution to deal with irrational consuming.
