Study On The Legal Mechanism Of Prevention Of Criminal Misjudged Case

Along with the progress of the society, the rule of law in China is becoming perfect.But from happening of some cases in recent years, the judicial field still exists many problems.There are many places which need to be perfect.How lawyers’ status can be improved.How to play its role in the prevention of miscarriages of justice.The relevant legislation is not detailed enough.This caused the high attention of the government and the whole society.Especially the incidence of miscarriages of justice has been hitherto unknown attention.Recently,Politics and Law Committee,the Supreme People’s Procuratorate and the Supreme People’s Court are introduced about the prevention of miscarriages of justice.Therefore,how to prevent miscarriages of justice is the important subject. Of course,theorists and judicial department are researching the reasons of misjudged cases and precaution and obtains theoretical results.The government makes some needed reforms.The new "criminal procedural law" proves China’s reform in the judicial system.The paper takes Zhejiang Nephew Case as a example.Through study on existing problems of this case,I find out the reasons of miscarriages of justice in china.Depend on the experience of developed countries in the prevention of miscarriages of justice,I put forward some reformation measures from each aspect.I hope that it is an enlightenment to the judicial system reformation.The first part of this paper introduces Zhejiang nephew.The second part analyzes the legal issues of the case. The third part expounds the prevention system of foreign countries and some enlightenments for china.The fourth part puts forward the way to perfect the law system to prevent the Criminal Misjudged Cases in our country.
