Network copyright is an extension of the traditional copyright under the network environment. Like a coin has two sides, network technology promotes the diffusion of knowledge, on the other hand, it also impacts the existing system of copyright protection. In recent years, the popularity of the web fiction not only has given rise to numerous professional writers, and someone with its great mind and outstanding writing success overnight, but also brought huge profit space for the network literature market. At the same time, the proliferation of online piracy works make the network copyright infringement phenomenon becomes a commonplace. To be worse, the complexity of the network copyright infringement increases the difficulty to maintain the author’s copyright. Obviously, the reconstruction of copyright protection system is imminent.In many infringement cases of the network copyright, the internet service provider(ISP) plays a special role. As the world’s largest Chinese search engine, Baidu promotes the development of the Internet in our country. Because of the involving problem is more complicated, Baidu library case was concerned widely. Based on the above, through analyzing the legal issues, and finding the lack of copyright protection in our country, the author put forward suggestions to strengthen the protection of network copyright. This article is divided into four parts:The first part will review the case, introduce contentious issues and legal issues.The second part will analyze the legal issues, and come up with the author’s opinions.The third part will resolve issues of the case.The fourth part will put forward author’s suggestions to the current Copyright law of our country.
