The Research On Payment Of Marine Eco-compensation

Seventy percent of the world is covered by the ocean, which the human live heavily by. Marine resources contribute to China’s rapid development. However, as the ability to exploit the marine resources constantly increases during the development of economy, marine bio-resource is much over exploited, as well as the marine pollution occurs frequently. The contradictory between the economic development and environmental protection, is truly caused by the unequal distribution of ecological interests between environment protectors and destroyers, and between sufferers and beneficiaries. Marine Eco-compensation regime is established just as to settle the issue. Its purpose is that collecting compensation from the beneficiaries who are benefit from exploiting marine resource, and as the same time, using the compensation to restore the environment and paying the sufferers for their damage they suffered. Since the Marine Eco-compensation is involved of economy interests what people highly concerned, it is the most critical component of the marine eco-compensation regime. In developed countries, the marine eco-compensation is always called "Payments for Ecosystem Services (PES)".This paper studies the marine eco-compensation as the pointcut, as to provide the basement for the whole study of marine eco-compensation regime.Since the marine eco-compensation regime is one type of eco-compensation regime, the study on former should be on the base of definitions and theories of the latter. In the first party of this paper, several definitions are presented, indicating the relationship between marine eco-compensation and eco-compensation. After some analyzing, the part clears out some elements involving marine eco-compensation, which lays a foundation for the following discussion.In the second part, the paper pays attention to advanced foreign experiences. This part majorly studies the eco-compensation undergoing of the America and the New Zealand, which providing new ideas for our country’s utilization on marine eco-compensation.The next part, the paper studies the current legislations about domestic marine eco-compensation regime and some practices put into coastal region. This is intent to find out the existing problems in domestic marine eco-compensation regime and utilization of eco-compensation.In the fourth part, the paper summarizes the domestic practices on marine eco-compensation utilization, also analyzes the foreign advanced "Payments for Ecosystem Services". After that, the paper provides some suggestions for the utilization of Chinese marine eco-compensation and the regime itself.
