Some Issues Credit Card Fraud

This article mainly researches on crime of credit cards swindling. It involves four Parts:Part Ⅰ, Combining with my understanding,I briefly analyzed and compared of the current situation of China’s legislative and foreign credit card fraud, in order to further improve the legislation of the crime. Then I analyzes the meaning of the intention of illegal occupation in this crime. This intention should be a dispensable subjective term and deduced from all kinds of behavior which offender acts. But it will be denied in the case of contrary evidence. Part Ⅱ:Discussion of the genera fraud difficult problems of credit card. I proposed some of my superficial insights and understanding of these question.Part Ⅲ:using forged credit cards, using false identification cheating credit card and fraudulent using of credit cards to others. I discussed the judicial determination of difficult problems of the three acts.partIV:Discussion some issues of credit card fraud. For the most controversial acts of malicious withdraw,I discussed a number of judicial determination on the issue and proposed some basic position on such cases.
