Government procurement is an important part of national financial expenditure, and it is an important tool government allocating resources. The amount of government procurement in China increased year by year and had reached1.3978trillion YUAN in2012which accounted for11.1%of financial expenditure. Government procurement has several policy goals, for instance, promoting the development of small and medium-sized enterprises(SMEs). However, the SMEs are faced with a dilemma in real government procurement. They not only can not get a fair chance to participate in government procurement, but also did not achieve the deserved support. Therefore, it is a practical demand and tendency to promote the development of SMEs by using the functions of government procurement policies.This study can be divided into the following three parts. The first part states the background, the significance, the overview of the research, the methodology and the innovations. The second part is the base of our study, in which we analyzes the difficulties SMEs facing on and the causes by investing large amounts of data and local case, based on the objective situations and the existing legal systems of government procurement. The third part is the study of legal measures. Firstly, we analyzed the experiences on promoting SMEs development through government procurement of United States, Germany, Japan and other developed countries. Second, we proposed the corresponding legal countermeasures, based on the national conditions, including establishing a sound legal system of government procurement, guaranteeing the SMEs can get a fair treatment in government procurement, establishing a unified electronic government procurement platform to share information, refine relevant government support system and improve supplier relief system...
