"The safety of food is always first," the phrase profoundly revealed the importance of food for the survival and development of humanity. Food quality and safety issues have been deeply related to health, social stability and economic development of mankind. However, with economic development, people’s living standards continue to improve. But food safety problems are endless. With growing globalization, food safety issues are also increasingly becoming a worldwide problem. Therefore, strengthening the legal system of food safety regulation is even more urgent. EU, U.S. and Japan are more perfect in the world’s food safety regulatory system, particularly in the EU. Research on the one hand, the European Food Safety legal system has profound theoretical significance. On the other hand, our country also has important practical significance by drawing on its experience.At present, there are still many problems in the food safety regulation of China. Food safety regulatory legal system is not perfect. Because it is lack of maneuverability, specific laws, regulations and implementing rules. Between regulatory bodies, they have unclear responsibilities, and long supervision. And in China, it is also lack of relevant food safety traceability system for food safety.Therefore, it can not be achieved the "production-processing-sale-sale" management. There are potential risks to food safety. In response to food safety emergencies, the warning are processing capacity. Accordingly, in order to further improving of Chinese food safety regulatory system and the improving of food safety regulatory capacity, we must learn or study food safety regulatory experience of advanced countries or regions to solve the above situation.To ensure the effective implementation of EU food safety, EU has comprehensive, systematic, flexible and workable legal system. To promote ourselves, we should take it as a warning and further strengthen food safety legislation to strengthen supervision norms. Then the food safety laws and regulations can cover "from farm to table" all aspects of the food supply chain. In the reform of the regulatory body, the principle of independence requirements in EU can help to establish the European Food Safety Authority. In China,it also need to strengthen the role of the Food Safety Commission and the co-ordination responsibilities of various departments.It also needs to unified management, promoting quality, business, health and other departments to perform their duties independently.The streamlined and efficient regulation of food safety traceability system build process, the EU adhere to the " farm to table " the whole process of management principles to establish traceability systems,insufficient emphasis on traceability of food and food ingredients. At this point, our country also needs to improve food production to enterprise through quality and technical means, the use of " traceability " system tools, good food packaging and management, so that it can be effective supervision. Finally, in terms of risk prevention, EU not only uses risk assessment, risk management and risk communication on food safety risk analysis, but also the rapid alert system for food safety supervision orderly conduct. In China, the establishment of an independent risk assessment body is an important means to strengthen the food safety risk management. At the same time, it should promote the establishment of food safety-related information disclosure and communication system, so that the public can be more timely, comprehensive understanding of the relevant information.
