The negotiation of Anti-Counterfeiting Trade Agreement is full of twists and turns.But it still reaches an agreement in2010to a certain pressure of developed countries. Thedeveloped countries such as the U.S. and the Europe secretly negotiated, formulated theAnti-Counterfeiting Trade Agreement. The agreement as a response to "the increase inglobal trade of counterfeit goods and pirated copyright protected works". This is aninternational treaty aimed at enhancing the standards of intellectual property rightsenforcement in the international trade. But the result we developing countries can notaccept. Even though the Europe did not sign it,but the agreement still has influence ondeveloping countries. Especially the forum of the ACTA. The ACTA still have greatinfluence on China’s export trade. So our government and enterprises should be prepared todeal with this kind of problems causing by the ACTA. Make good use of The12thFive-Year Plan for the Development of Intellectual Property Rights Business of thePeople’s Republic of China to enhance our country’s ability and puts forward somecountermeasures from the government and enterprise aspects.This paper includes four parts:The first chapter, analyzed the background of the Anti-Counterfeiting TradeAgreement,as well as the latest developments of theAgreement.The second chapter, Introduced the main contents of the Anti-Counterfeiting TradeAgreement. Its contents are focused on civil enforcement, criminal enforcement, bordermeasures and the enforcement of intellectual property rights in the digital environment.ThethirdchapteristhedialecticalrelationshipbetweentheTRIPSagreementandtheACTA.The fourth chapter is the influence of anti-counterfeiting trade agreement and China’scountermeasures.Even if our country does not join into ACTA, this agreement also hasgreat influence on China’s export trade. So this chapter puts forward some countermeasuresfrom the government and enterprise aspects.
